Since January 2019, the Packaging Act (VerpackG) has required all companies placing sales packaging on the market to fulfill three obligations: registration and data reporting with the Central Packaging Register Office and system participation with a dual system.

These are your VerpackG obligations:

  1. Affected retailers are required to register with the Central Packaging Register Office in the publicly accessible register LUCID (=registration obligation).
  2. By paying a licensing fee, which is calculated based on the quantity and type of packaging, companies participate in a dual system (e.g. Dual System Interseroh via the online shop Lizenzero). Through this packaging licensing, companies contribute to the proper recycling of their packaging (=system participation obligation).
  3. Finally, companies must report the licensed packaging and the name of the dual system (e.g. Interseroh) in the LUCID register (=data reporting obligation).
  4. Important: All data from the dual system must always match the data entered in LUCID!

Companies that place so-called sales packaging (shipping, service, and product packaging) on the market, which is ultimately disposed of by private end consumers, are subject to the Packaging Act.

All sales packaging must be licensed with a dual system. This includes:

  • Shipping packaging: Packaging used to ship goods (e.g. a cardboard box), including all filling and packing materials (e.g. parcel tape, bubble wrap)
  • Service packaging: Packaging used to hand over goods (e.g. paper bags for bread rolls, to-go cups)
  • Product packaging: Packaging used to protect goods (e.g. yogurt cups)

Using the publicly accessible LUCID register, the Central Packaging Register Office can check whether companies are fulfilling their obligations. Additionally, businesses can see whether competitors are complying with the Packaging Act. Non-compliance is considered an administrative offense and may result in sanctions such as fines of up to €200,000.

The registration, system participation, and data reporting obligations must be fulfilled before the first packaging is placed on the market.
By December 31 of each year, a forecast report for the following year must be submitted (initial planned quantity report).
By May 15 of the following year, the actual packaging volumes placed on the market must be reported in the final annual quantity report.

Important: All reports must be submitted both in the LUCID account and in the account of the dual system to ensure data consistency.

Since online retailers ship goods to private households using packaging, they must comply with the obligations of the Packaging Act. If a retailer uses a fulfillment service provider or operates via dropshipping, special rules apply regarding compliance.
